REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: I) Existing litigation pursuant to Government code 54956.9; Yurok Tribe v Del Norte County Board of Supervisors, State of California 01-14-0001-0483 II) Anticipated litigation 1)  Initiation of litigation Conference with Legal Counsel pursuant to Gov’t Code 54956.9(d)-one case  2) Significant exposure Conference with Legal Counsel pursuant to Gov’t Code 54956.9(d)- one case -  (c); III) Personnel negotiations pursuant to Government Code 54957.6 between County Negotiator and the Del Norte County Employees' Association, Sheriff's Employees' Association, and represented and unrepresented bargaining units; IHSS Negotiations.

10:00 A.M. Call the meeting to order and take roll.

·        Moment of Reflection

·        The Pledge of Allegiance to be led by Gerry Hemmingsen, District 4 Supervisor.

·        Introduction of new employees to the Board of Supervisors

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports. In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive a brief report from the County Administrative Officer.

CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

1.    Approve Minutes from the June 23, 2015 Board of Supervisors Meeting.**

2.    Approve and authorize the Chair to sign Agreement with the State of California requiring the County to continue to adhere to community mental health program requirements and authorize the Director of Health and Human Services to sign the contract and any associated or required documents as they relate to the contract as requested by the Director of Health and Human Services.**

3.    Approve and authorize the Chair to sign Agreement with Remi Vista, Inc. for Medi-Cal eligible children, youth and their families' mental health services from July 1, 2015 through June 30, 2016 as requested by the Director of Health and Human Services.**

4.    Approve and authorize the Chair to sign Agreement with Skyway House for adult residential treatment of alcohol and other drug abuse from July 1, 2015 through June 30, 2016 not to exceed $31,000.00 as requested by the Director of Health and Human Services.**

5.    Approve and adopt the joint Resolution 2015-055 between the County of Del Norte, City of Crescent City and Del Norte Healthcare District supporting efforts to ensure high quality health care in the region and authorize the Chair to sign it as requested by the County Administrative Officer.**

6.    Approve and authorize Chair to sign Agreement with Davis Guest Homes, Inc., Modesto, CA for Augmented Adult Mental Health Residential Support Services for the period July 1, 2015 through June 30, 2016 as requested by the Director of Health and Human Services.**

7.    Approve and authorize the Chair to sign the Agreement with Restpadd, Inc., Redding, CA to provide acute inpatient psychiatric services from July 1, 2015 through June 30, 2016, not to exceed $155,000.00 as requested by the Director of Health and Human Services.**

8.    Approve and authorize the Probation department to finance plaques for employees to be presented at the 21st annual LEADN Awards as requested by the Chief Probation Officer.**

9.    Approve and adopt Proclamation supporting probation services week that aknowledges the role that probation plays in community corrections in Del Norte County as requested by the Chief Probation Officer.**

10. Approve and authorize the Chair to sign the first Amendment to the Agreement with Redwood Toxicology for products and services as requested by the Chief Probation Officer.**

11. Approve and authorize Chair to sign Agreement with the Western Riverside Council of Governments (HERO) for the Collection of Special Taxes and Special Assessments as requested by the County Administrative Officer.**

BUDGET TRANSFERS:

12. Approve and adopt Budget Transfer 06-07 in the amount of $4,059.22 within the Federal Title III Budget Unit as requested by the Director of the Community Development Department.**

13. Approve and adopt Budget Transfer 06-08  in the amount of $10,000.00 within the Hospital Preparedness (HPP) Budget as requested by the Assistant County Administrative Officer.**

14. Approve and adopt Budget Transfer 06-09 in the amount of $30,000.00 from the General Fund Contingency Budget to the Public Defender Budget as requested by the Assistant County Administrative Officer.**

15. Approve and adopt Budget Transfer 06-12 in the amount of $9,000.00 within the Probation Food Budget as requested by the Chief Probation Officer.**

16. Approve and adopt Budget Transfers 06-14; 06-15; 06-16 and 06-17 within the Intrafund Community Development Department Allocation, Code Enforcement and Environmental Health Divisions as requested by the Director of the Community Development Department.**

SCHEDULED ITEMS:

17. 10:25 A.M.COMMENT PERIOD:  Members of the public may address the Board on matters which are within the jurisdiction of the Board.  If you are addressing the Board regarding a matter listed on the agenda, you may be asked to hold your comments until the Board takes up that matter.  Please limit your comments to three minutes or less.

18. 10:30 A.M. Conduct a Public Hearing to provide the public an opportunity to hear and provide comment on the results of activities involved in the Community Development Block Grants (CDBG) 10-EDEF-7264 and 12-CDBG-8381 and accept the final results through these grants as meeting the requirements of the grant and the various agreements between the County and sub recipients as requested by the County Administrative Officer.

19. 10:45 A.M. Receive a report from the Assistant Director of the Community Development Department regarding new Ground Water Management rules and effect upon the County.

REGULAR ITEMS

GENERAL GOVERNMENT:

20. Approve and authorize the purchase and installation of the National Motto’s and County Seal within the Del Norte County Flynn Center based on the recommendation from the Future Facilities Committee as requested by the County Administrative Officer.**

21. Approve and authorize the Chair to sign Intergovernmental Agreement Between the Yurok Tribe, Del Norte County, and the State of California Concerning Mitigation Surrounding the Tribe's Hotel and Gaming Facility Project as requested by the County Administrative Officer.**

LEGISLATIVE AND BUDGET ISSUES:

22. Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.
