REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: (a) Conference with Legal Counsel- Existing litigation pursuant to Government Code 54956.9(d)(1) Floyd Squires v. Del Norte County SC160146; (b) Conference with Legal Counsel- Anticipated litigation 1) significant exposure to litigation pursuant to Government Code 54956.9(d)(2) – one; 2) Initiation of litigation pursuant to Government Code 54956.9(d)(4) – none; (c) Conference with Labor Negotiators pursuant to Government Code 54957.6 between County Negotiator: Jay Sarina, CAO and SEIU; (d) Conference with Real Property Negotiators: Property: APN 11502018 Sitka Spruce/Crescent City Marsh Agency Negotiator: Jay Sarina, CAO; Negotiating Party: Hambros; Under Negotiation: transfer to County including but not limited price and terms of payment. 10:00 A.M. Call the meeting to order and take roll.

·        Moment of Reflection

·        The Pledge of Allegiance to be led by Gerry Hemmingsen, District 4 Supervisor.

·        Introduction of new employees to the Board of Supervisors

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports.

·        Receive a brief report from the County Administrative Officer.

CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

1.    Approve and adopt Minutes from the June 28, 2016 Board of Supervisors Meeting.**

2.    Approve and adopt a Resolution honoring David Mason for his 11 plus years of service to the County as requested by the Director of the Community Development Department.**

3.    Approve and authorize the Assistant Director of Health and Human Services to sign an Agreement and any other required documents related to this contract with the State of California requiring the County to continue to adhere to community mental health program requirements as requested by the Assistant Director of Health and Human Services.**

4.    Approve and authorize the Del Norte County Department of Health and Human Services to apply for the continuation of the Nutrition Education and Obesity Prevention (NEOP) grant and authorize the Assistant Director  to sign the contract and any associated or required documents as they relate to the contract as requested by the Assistant Director of Health and Human Services.**

5.    Approve and authorize the Chair to sign an Agreement with Oxford House Beachside to provide clean and sober residential services from July 1, 2016 through June 30, 2017 not to exceed $13,500.00 as requested by the Assistant Director of Health and Human Services.**

6.    Approve and authorize the Chair to sign the First Amendment to the Agreement with Davis Guest Homes, Inc., (DNCO Agreement #2015-088) Modesto, CA. for Augmented Adult Mental Health Residential Support Services for the period July 1, 2015 through June 30, 2016 not to exceed $165,000.00 as requested by the Assistant Director of Health and Human Services.**

7.    Approve and authorize the Chair to sign an Agreement with Keith Taylor for professional services for the period July 1, 2016 through June 30, 2017, not to exceed $25,000.00 as requested by the Assistant Director of Health and Human Services.**

8.    Approve and authorize the Chair to sign the First Amendment to Agreement #13-5003 (DNCO Agreement #2013-080) with the California Department of Social Services for Agency Adoption Services from July 1, 2013 to June 30, 2017 not to exceed $170,915.00 each fiscal year as requested by the Assistant Director of Health and Human Services.**

9.    Approve and authorize the Chair to sign an Agreement with Crisis Support Services of Alameda County in Oakland, CA for After-Hours Crisis Support Services from July 1, 2016 through June 30, 2017, not to exceed $17,940.00 as requested by the Assistant Director of Health and Human Services.**

10. Approve the Megabyte (MPTS) Property Tax System Maintenance Rates for 2016/17 as requested by the Treasurer-Tax Collector, Auditor Controller and Assessor.**

11. 1) Approve the reappointment of Daphane Williams as a Board of Supervisors appointed Public Agency member of the Local Planning Council for Child Care & Development for a term of two years and 2) Approve the reappointment of Melodee Fugate as a Board of Supervisors appointed Child Care Provider member of the Local Planning Council for Child Care & Development with a term of two years and 3) approve the reappointment of Angela Glore as a Board of Supervisors appointed Alternate member of the Local Planning Council for Child Care & Development for a term of two years as requested by the Local Planning Council for Child Care and Development Coordinator.**

SCHEDULED ITEMS:

12. 10:25 A.M.COMMENT PERIOD:  Members of the public may address the Board on matters which are within the jurisdiction of the Board.  If you are addressing the Board regarding a matter listed on the agenda, you may be asked to hold your comments until the Board takes up that matter.  Please limit your comments to three minutes or less.

13. 10:30 A.M. Del Norte County Fair Junior Livestock Auction Committee Presentation.

REGULAR ITEMS

GENERAL GOVERNMENT:

14. Waive full reading and adopt the Ordinance creating Title 19 Fire Safe Regulations and deleting Chapter 14.16 and Amending Section of Titles 12 and 14 as requested by the Director of the Community Development Department.**

15. Continue the Public Hearing, waive full reading and adopt an Ordinance amending Title 21 of the Del Norte County Code (Coastal Zoning Ordinance) and adopt a Resolution authorizing transmittal of the Ordinance to the California Coastal Commission for certification as requested by the Assistant Director of the Community Development Department**

16. Allow the temporary closure of Klamath Boulevard in Klamath, CA beginning at the south side of the Yurok Tribal Office (190 Klamath Blvd.) and ending a distance of approximately 1,000 feet south near the golden bears. The closure will be from 8:00 A.M. to 5:00 P.M. on Saturday August 20, 2016 as requested by the Assistant Engineer.**

17. Discuss and give direction to the County Administrative Officer to draft a response to the 2015/16 Grand Jury Report.

LEGISLATIVE AND BUDGET ISSUES:

18. Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

19. Approve and adopt the Mental Health Services Act (MHSA) Three Year Program and Expenditure Plan, Annual Update FY 2016-2017 as requested by the Assistant Director of Health and Human Services.**
