REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: (a) Conference with Legal Counsel- Existing litigation pursuant to Government code 54956.9(d)(1) David H. Egan v. Del Norte County et. al. CVUJ 14-1046; one Worker’s Compensation case (b) Conference with Legal Counsel- Anticipated litigation 1) significant exposure to litigation pursuant to Govt’ Code 54956.9(d)(2) – one; 2) Initiation of litigation Conference with Legal Counsel pursuant to Govt’ Code 54956.9(d)(4) – none; (c) Conference with Labor Negotiators pursuant to Government Code 54957.6 between County Negotiator: Jay Sarina, CAO and SEIU

REGULAR SESSION 10:00 A.M.

10:00 A.M. Call the meeting to order and take roll.

·        Moment of Reflection

·        The Pledge of Allegiance to be led by Martha McClure, District 2 Supervisor.

·        Introduction of new employees to the Board of Supervisors

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports. In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive a brief report from the County Administrative Officer.

SCHEDULED ITEMS:

1.    10:25 A.M.COMMENT PERIOD:  Members of the public may address the Board on matters which are within the jurisdiction of the Board.  If you are addressing the Board regarding a matter listed on the agenda, you may be asked to hold your comments until the Board takes up that matter.  Please limit your comments to three minutes or less.

2.    10:30 A.M. Adjourn as the Board of Supervisors, reconvene as the Board of Equalization, and conduct a Public Hearing for a Change of Assessment (Crescent Temple Association),  APN 118-280-08 RY 14/15.**

3.    10:45 A.M. Conduct a Public Hearing for a Change of Assessment (Hernandez),  APN 118-130-16 RY 13/14.**

4.    11:00 A.M. 1) Adjourn as the Board of Equalization, reconvene as the Board of Supervisors, and conclude the Public Hearing and adopt the 2016/2017 Fiscal Year Recommended Budget and all the Special District Budgets by Resolution as presented over the course of the budget hearings, and 2) Adopt Resolution 2016-133, a Resolution Fixing Tax Rates for Fiscal Year 2016/2017 per Government Code; and 3) Adopt Resolution 2016-134 setting the appropriation limits for Fiscal Year 2016/2017, and 3) Adopt Attachment "A" outlining staffing changes, including establishing positions with an effective date of October 1, 2016 as requested by the County Administrative Officer.**

5.    11:15 1) Hold a public hearing, waive full reading and introduce by title only the proposed Ordinance and Resolution related to a General Plan Amendment and an immediate TPZ rezone of APN 105-020-40, as requested by Green Diamond Resource Company and 2) direct staff to return the project for final approval after evidence of the State's approval of the timberland conversion is received as requested by the Assistant Director of the Community Development Department.**

CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

6.    Approve and adopt Minutes from September 13, 2016 Board of Supervisors Meeting.**

7.    Approve and adopt a Resolution by the Del Norte County Board of Supervisors supporting the Del Norte County Literacy Initiative as requested by Building Healthy Communities.**

8.    Approve and adopt a Proclamation recognizing September 27, 2016 as National Voter Registration Day as requested by the Del Norte County Registrar of Voters.**

9.    Approve and authorize the re-appointment of David Finigan to the California State Association of Counties Board of Directors as the Del Norte County Representative for the year 2017.

10. Approve and adopt a Resolution authorizing the County Administrative Officer to sign the Agreement with the California Department of Food and Agriculture to allow inspections to be conducted according to the California Organic Foods Act as requested by the Agricultural Weights and Measures Inspector.**

11. Approve and authorize the Chair to sign the Agreement with Rebecca Linkous, Karen Olson, and Thomas French, Attorneys at Law, for Public Defender services, and with Michael Skudstad and Joseph Futrell for Alternate Public Defender services as requested by the County Administrative Officer.**

12. Approve and authorize the Chair to sign the attached letter of appointment for Heather Snow, Director of Health and Human Services (DHHS) as the new Mental Health Director as requested by the Director of Health and Human Services.**

13. Approve and authorize the Chair to sign the Residential Lease Agreement with Fernando Pereira for a single family residence at 667 9th Street Apartment B located in Crescent City, CA on a month-to-month basis beginning October 1, 2016, for an amount not to exceed $800.00 per month or $10,400.00 per year as requested by the Director of Health and Human Services.**

14. Approve and authorize the Chair to sign the Residential Lease Agreement with Fernando Pereira for a single family residence at 678 C Street Apartment B located in Crescent City, CA on a month-to-month basis beginning October 1, 2016, for an amount not to exceed $800.00 per month or $10,400.00 per year as requested by the Director of Health and Human Services.**

15. Approve the Resolution and Participation Agreement with the California Housing Finance Agency (CalHFA) for the Local Government Special Needs Housing Program and authorize the Director of Health and Human Services to sign the Agreement as requested by the Director of Health and Human Services.**

16. Approve and authorize the Chair to sign the Agreement with St. Helena Hospital located in St. Helena, CA for psychiatric Inpatient Hospital Services for the period July 1, 2016 through June 30, 2017, not to exceed $15,000.00 as requested by the Director of Health and Human Services.**

17. Approve and authorize the Chair to sign the Agreement with St. Helena Hospital Center for Behavioral Health located in Vallejo, CA for Psychiatric Inpatient Hospital Services from July 01, 2016 through June 30, 2017, not to exceed $15,000.00 as requested by the Director of Health and Human Services.**

18. Approve and authorize the Chair to sign the Agreement with Coast Auto Center, Inc. for the period July 01, 2016 through June 30, 2017, not to exceed $20,000.00 as requested by the Director of Health and Human Services.**

19. Approve and authorize the Chair to sign the Agreement with HASP Clean and Sober Living to provide clean and sober residential services from July 01, 2016 through June 30, 2017, not to exceed $36,500.00 as requested by the Director of Health and Human Services.**

REGULAR ITEMS

GENERAL GOVERNMENT:

20. Approve and authorize the Chair to send the attached letter to the California Department of Fish and Wildlife not opposing the proposed designation of a section of the upper South Fork of the Smith River as a "Heritage Trout" water as requested by Chair Hemmingsen.**

21. Approve the proposed policies for the Probation Department: Training Policy, Report Preparation, Mutual Aid and Outside Agency Assistance, Department Owned and Personal Property, Body Armor, Personal Appearance Standards and Department Badges as requested by the Chief Probation Officer.**

22. Approve the proposed Canine Policy for the Probation Department as requested by the Chief Probation Officer.**

LEGISLATIVE AND BUDGET ISSUES:

23. Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

24. Review, make any necessary amendments and adopt the 2016/2017 County Legislative Platform as presented as requested by the County Administrative Officer.**
