REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: (a) Conference with Legal Counsel- Existing litigation pursuant to Government code 54956.9(d)(1) Grassroots v. California Coastal Commission et al. Superior Court of California, County of San Diego, Case No. 37-2016-00006073-CU-MC-CTL; Mike Riese v. County of Del Norte, et al. Case No. CV 12-3723 WHO; Five Worker’s Compensation Cases (b) Conference with Legal Counsel- Anticipated litigation 1) significant exposure to litigation pursuant to Govt’ Code 54956.9(d)(2) – one; 2) Initiation of litigation Conference with Legal Counsel pursuant to Govt’ Code 54956.9(d)(4) – one; (c) Conference with Labor Negotiators pursuant to Government Code 54957.6 between County Negotiator: Jay Sarina, CAO and SEIU; (d) Conference with Real Property Negotiators: Property: APN 140-140-2 Klamath Baseball Field Agency Negotiator: Jay Sarina, CAO; Negotiating Party: Yurok Tribe; Under Negotiation: transfer to Tribe including but not limited price and terms. REGULAR SESSION 10:00 A.M.

10:00 A.M. Call the meeting to order and take roll.

·        Moment of Reflection

·        The Pledge of Allegiance to be led by David Finigan, District 5 Supervisor.

·        Recognition of Heroism of local responders to an active shooter in Crescent City on the afternoon of September 27, 2016 as requested by the Sheriff-Coroner.

·        Introduction of new employees to the Board of Supervisors

Action: New Sheriff’s Department Employees: Kayleb Mcintire-Correctional Officer; Kristen DeBacker-Correctional Tech; Linda Dunsmore.

·        Report of any actions from closed session by County Counsel.

Action: None

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

Action: Item #3 will not be discussed due to the applicant withdrawing the appeal after the posting of the Agenda.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports.

Action: Supervisor Gitlin:  Attended the Stakeholders Group meeting with Congressman Huffman and Congressman DeFazio, participated in the Chili Cook off at the Latter Day Saint Temple, attended the Mental Health Board meeting and also attended the Hiouchi Café new owner Open House.

Supervisor McClure: Nothing to report.

Supervisor Howard:  Attended the Tri-Agency meeting, participated in a discussion with the NCRWQB on surface quality on the Smith River, attended the Stakeholders Group meeting with Congressman Huffman and Congressman DeFazio, attended an Economic Development meeting, attended the Smith River Fire Protection District meeting, attended the CA Fish and Game Commission meeting, attended the Hiouchi Café new owner Open House and also attended a dinner at the Humboldt County Farm Bureau.

Supervisor Finigan: Attended the Tri-Agency meeting, attended numerous meetings with Congressman Huffman and Congressman DeFazio, attended the BCRAA meeting, attended the grand opening of the Art Gallery on 2nd Street and also dealt with numerous constituent issues and concerns.

Supervisor Hemmingsen: Attended the NORTEC meeting, attended a meeting with Congressman Huffman and Congressman DeFazio and spoke at Jed Smith State Park, met with staff regarding the Red Fox Project, participated in Agenda Review, attended the BCRAA meeting, attended the Smith River Fire Protection District meeting and also participated in the Smith River National Recreation Collaborative meeting.

 

·        Receive a brief report from the County Administrative Officer.

Action: CAO Sarina:  Been involved in Employee Negotiations, attended a meeting with County Counsel and the Yurok Tribe in regards to the Klamath Baseball Field, attended numerous meetings with Administration Staff, reviewing loan documents for BCRAA, attended a meeting with CDD and the Tolowa Dee’ni Nation regarding proposals, attended the OES Area Ops meeting and also participated in a Conference Call with Senator McGuire.

SCHEDULED ITEMS:

1.    10:25 A.M.COMMENT PERIOD:  Members of the public may address the Board on matters which are within the jurisdiction of the Board.  If you are addressing the Board regarding a matter listed on the agenda, you may be asked to hold your comments until the Board takes up that matter.  Please limit your comments to three minutes or less.

2.    10:30 A.M. Adjourn as the Board of Supervisors, reconvene as the Board of Equalization and conduct an Assessment Appeal Hearing (George Mavris) APN 120-233-04 RY 13/14.**

Action: Supervisor Finigan recused himself due to conflict of interest. The Board of Equalization unanimously voted to uphold the Assessor’s Value due to the applicant’s failure to appear at the hearing.

Action: This item wasn't discussed due to the applicant withdrawing the Appeal after the Agenda was posted.

4.    11:00 A.M. Conduct an Assessment Appeal Hearing (Rhonda Curtis) APN 106-191-38 RY13/14**

Action: The Board voted unanimously to deny the application and upheld the Assessor’s valuation.

Action: The Board of Equalization denied the application due to lack of appearance by the applicant

8.    Approve and adopt a Resolution supporting the national effort to combat rural child poverty as requested by Supervisor Finigan.**

Action: Approved. RESO#2016-147

9.    Approve and adopt a Resolution honoring Michael Leavitt, retiring Sheriff's Civil Clerk as requested by the Sheriff-Coroner.**

Action: Approved. RESO#2016-146

10. Approve and authorize the Chair to sign the first Amendment to Agreement #2016-126 for Public Defender Services as requested by the County Administrative Officer.**

REGULAR ITEMS

GENERAL GOVERNMENT:

11. Continue the Public Hearing, waive full reading, and adopt the proposed Ordinance to allow the First 5 Commission to define that its current membership of "not less than seven no more than nine" will include two non-voting alternate members as requested by the Executive Director of the First 5 Commission.**
