REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: (a) Conference with Real Property Negotiators in accordance with Gov't Code 54954.5: Property: APN 140-140-2 Klamath Baseball Field Agency Negotiator: Jay Sarina, CAO; Negotiating Party: Yurok Tribe; Under Negotiation: transfer to Tribe including but not limited price and terms; (b) Conference with Legal Counsel- Existing litigation pursuant to Government Code 54956.9(d)(1); Pacific Shores vs. County of Del Norte et. al CVPT 06-1454;  Conference with Legal Counsel- Anticipated litigation 1) significant exposure to litigation pursuant to Govt’ Code 54956.9(d)(2) – one; 2) Initiation of litigation Conference with Legal Counsel pursuant to Govt’ Code 54956.9(d)(4) – none; (c) Conference with Labor Negotiators pursuant to Government Code 54957.6 between County Negotiator: Jay Sarina, CAO and SEIU; (d) Public Employee Performance Evaluation: Title: None.

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports. CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

1.    Approve and adopt Minutes from the April 25, 2017 Board of Supervisors meeting.**

2.    Approve and authorize the acceptance of a donation from Del Norte Association for Cultural Awareness (DNACA) to re-do the mural on the front of the Veteran's Memorial Building located at 810 H Street, as requested by Veteran Service Officer.**

3.    Approve and adopt a Resolution, authorizing the County Administrative Officer to sign the Nursery Inspection Agreement between the Del Norte County Department of Agriculture and the California Department of Food and Agricultures,  as requested by Weights and Measures Inspector IV.**

4.    Approve and adopt a Proclamation declaring May 2017 as Mental Health Month, as requested by Director of Health and Human Services.**

5.    Approve and adopt a Proclamation designating the week of May 21st - 27th, 2017 as Emergency Medical Services Week, as requested by Del Norte Ambulance.**

6.    Approve and authorize annual merit increase for the Director of the Community Development Department.

7.    Approve and authorize the Chair to sign the Fourth Amendment to the Agreement with George Mavris, Attorney at Law (original agreement 2013-038) for Public Defender Services for Pelican Bay State Prison Inmates, as requested by County Administrative Officer.**

8.    Approve and authorize the Chair to sign the Fourth Amendment to the Agreement with James Fallman, Attorney at Law (original agreement 2013-039) for Public Defender Services for Pelican Bay State Prison Inmates, as requested by County Administrative Officer.**

9.    Approve and authorize the Chair to sign the First Amendment to the Agreement for Psychological Examinations for County Employees (original agreement 2014-113)  between the County and Ronn M. Johnson, Ph.D, as requested by County Administrative Officer.**

10. Approve and authorize the Chair to sign a Memorandum of Agreement with the City of Crescent  City regarding the joint acquisition and use of a pipe line inspection camera contingent upon final authorization to use Homeland security Grant Program Funds, as requested by Community Development Director.**

11. Approve and authorize the award of the Construction Contract for the Big Flat Road at Hurdygurdy Creek Bridge Replacement Project to Steelhead Constructors, Inc. in the amount of $3,313,397; and authorize the Chair tosign the agreement; and further authorize the County Engineer to sign Change Orders totaling up to $190,,679.85. as requested by Community Development Department Assistance Engineer.**

12. Approve and authorize the award of the Construction Management and Inspection Services Contract for the Big Flat Road at Hurdygurdy Creek Bridge Replacement Project to Ghiradelli Associates, as requested by Community Development Department Assistant Engineer.**

BUDGET TRANSFERS:

13. Approve Budget Transfer 04-08 in the amount of $68,000 within the 254 Sheriff-Coroner Budget based on current costs and year end projections, as requested by Sheriff-Coroner.**

14. Approve Budget Transfer 04-09 in the amount of $6,500 within the 254 Sheriff's Coroner Budget based on current costs and year end projections, as requested by Sheriff-Coroner.**

15. Approve Budget Transfer 04-10 in the amount of $4,000 within the 238 Inmate Welfare budget unit based on year end projections of Mental Health Services and agreed upon between the Sheriff's Office and the Department of Health and Human Services, Mental Health Branch, as requested by Sheriff-Coroner.**

16. Approve Budget Transfer 05-01 in the amount of $90,000 within the 307-077 County Service Area No. 1 Budget for the purchase of a sewer line inspection camera, as requested by Community Development Department Director.**

17. Approve Budget Transfer 05-02 in the amount of $25,000 within the 231/254 budget based on current costs and year end projections, as requested by Sheriff-Coroner.**

SCHEDULED ITEMS:

19. 10:20 A.M. Update on Del Norte Ambulance (John Pritchett, General Manager)

20. 10:30 A.M. Approve and Authorize the Application to Building Healthy Communities through the California Endowment for funding the Del Norte County Summer Day Camp Program  (Kelsey Bozeman, Recreation Coordinator).

21. 10:40 A.M. Discuss and take possible action on the report of Bar-O Financial Issues and Alternatives.** (Lonnie Reyman, Chief Probation Officer; Jay Sarina, County Administrative Officer)

22. 10:50 A.M. Receive Update on Sustainable Groundwater Management Act from Staff and direct Staff to continue coordination with other local agencies on GSA formation and return to Board for possible action at next Board Meeting, as requested by Community Development Department, Assistant Director.**

REGULAR ITEMS

GENERAL GOVERNMENT:

23. Discuss and direct Staff to begin discussions with Harbor Commission on how to provide for Port-a-Potties on South Beach, as requested by Supervisor Berkowitz.

24. Discuss and direct staff to take the following actions: (1) Pursue a Coastal Development Permit from the California Coastal Commission for a Temporary Host Station at the Pacific Shores Subdivision; (2) Return to the Board of Supervisors when the Coastal Permit is approved with an implementation plan for the temporary host station including but not limited to site development, operation, construction budget, operation budget, finalizing transfer of ownership/responsibility of the RV from the County Department of Health and Human Services to the County Parks Department and identification of partnerships with other agencies/entities; and (3) Work with County Counsel in all aspects of the project development to ensure the County's interest is protected, as requested by Community Development Department Director.**

25. Approve and authorize staff to submit a National Fish and Wildlife Foundation grant application upon posting of the Request for Proposal, as requested by Community Development Department Director.**

26. Discuss and take possible action on Board of Supervisor term limits; Review draft resolution and draft ordinance and once reviewed and changes have been made as directed; direct staff to set a public hearing on the matter, as requested by Deputy County Counsel, Sean Collins.**

LEGISLATIVE AND BUDGET ISSUES:

27. Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

28. Discuss the 2017 Del Norte County Budget Process (Jay Sarina, County Administrative Officer).**

29. Supervisor Berkowitz requested to place a letter of support addressed to the Chairman of the White House Council on Environmental Quality urging Last Chance Grade to be placed as a high priority project on Executive Order 17366 on the upcoming May 23, 2017 Board of Supervisors Agenda.

30. Supervisor Berkowitz requested to place a letter of support addressed to Chairman Rodney Frelinghuysen of the Appropriations Committee, copying majority Staff Director Nancy Fox, Minority staff Director Shalanda Young and also Congressman Huffman asking for a hearing on H.R. 2344 regarding The Crab Emergency Disaster Assistance Act of 2017 on the upcoming May 23, 2017 Board of Supervisors Agenda.

31. Supervisor Berkowitz requested to place a letter of support addressed to Chairman Rodney Frelinghuysen of the Appropriations Committee, copying majority Staff Director Nancy Fox, Minority staff Director Shalanda Young and also Congressman Huffman asking for a hearing on H.R. 2330 regarding The Yurok Tribe Klamath River Chinook Salmon Emergency Disaster Assistance Act of 2017 on the upcoming May 23, 2017 Board of Supervisors Agenda.
