The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

10:00 A.M. Call the meeting to order and take roll.

·        The Pledge of Allegiance to be led by Gerry Hemmingsen, Vice-Chair.

·        Introduction of new employees to the Board of Supervisors

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time. In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports.

Action: Supervisor Gitlin: Attended the Redwood Coast Transit Authority (RCTA) meeting; Special thanks to the Lions Club for sponsoring Subway lunches for the Pelican Bay Median Clean Up; also thanks to Animal Control as well as the Probation Department for the wood chip project and is looking forward to more collaboration; attended the celebrations of life for Keith Jones and Diane Riedell; also had multiple meetings/ calls with constituents in relation to the collateral behavior of those in our community without shelter; also wishes to see an item on the next agenda in relation to the 2nd Amendment that is being adopted at other communities in California is addition to the Resolution adopted previously considering we have 3 new board members.

Supervisor Cowan: Attended Border Coast Regional Airport Authority meeting; after the last meeting traveled to Santa Barbara for her daughter’s graduation from U.C. Santa Barbara; also attended the Employee Appreciation luncheon.

Supervisor Howard:  Had conversation with Matt Brady regarding the encroachment permit issue and obtaining the permit to place port o’ potties within the Caltrans easement;  also attended the Pre-Fire Season meeting; Attended the ribbon cutting for the new Tolowa housing project; Attended the Natural Resources Committee meeting; had discussions with NVC Sports in relation to trip to Japan in July; conversations regarding trip to Japan and our bringing Redwood Trees for planting in Rikuzentakata; attended a meeting with USDA regarding infrastructure grant for Economic Development opportunities in our community; attended Solid Waste meeting;  thanks to the Del Norte Office of Emergency Services and CAO regarding fire event discussions with Gasquet community; attended an Resource Conservation District meeting; meeting with Roads regarding graffiti; Attended an Air Quality meeting; looking forward to an upcoming Economic Development Symposium being held at College of the Redwoods; attended the Employee Appreciation luncheon; attended Local Transportation Commission regarding Richardson Grove and Judge decision and wanted to remind everyone about the public meeting for Elk Valley Cross Road on June 26, 2019 at 4:30 p.m. at Sunset High School.

Supervisor Hemmingsen: Attended the Border Coast Regional Airport Authority meeting, attended a Pre-Fire Season meeting at the Gasquet first district offices; attended the Natural Resources Committee meeting; attended a Whale/Crab Coalition meeting; attended RCRC meeting in Sacramento. 

Supervisor Berkowitz: Attended the Crescent City / Del Norte Chamber of Commerce Mixer as well as the 4th of July planning session;  Chamber has hired Cindy Vosburg as the new Executive Director of the Chamber; Met with City Councilmember Isaiah Wright to discuss items of mutual concern; participated in the RCTA meeting; drafted letter as representative of District 5 concerning Caltrans’s regarding the delayed response to an encroachment permit for Port O’ Potties; also suggests adding to a future agenda the need for reports out from outside meeting.

 

CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

1.    Approve and adopt minutes from the June 11, 2019 Board of Supervisors meeting.**

2.    Approve and adopt a Proclamation designating July as Park and Recreation Month as requested by the Recreation Coordinator.**

3.    Approve and adopt a Resolution for the Revolving Petty Cash fund for the Sheriff's Office as requested by the Sheriff-Coroner.**

4.    Approve and authorize the Chair to sign an Agreement with Charles E. Rafferty and the Department of Child Support Services to provide local Service of Process (SOP) as requested by the Director of Child Support Services.**

5.    Approve and authorize the Chair to sign an Agreement with Sutter Coast Hospital and the Department of Child Support Services to provide Paternity Declarations as requested by the Director of Child Support Services.*

6.    1) Approve the Mental Health Services Act Annual Update FY 2019-2020 and authorize the budgets; and 2) authorize the Director of Health and Human Services (DHHS), Heather Snow to sign the plan on behalf of DHHS as requested by the Director of Health and Human Services.**

7.    Approve the board appointment renewal for the Local Mental Health Board member Clarke Moore for an additional three-year term as requested by the Director of Health and Human Services.**

8.    Approve and authorize the Chair to sign the Agreement with JUMP Technology Services, LLC for Software Maintenance and Support Services for the period July 01, 2019 through June 30, 2022, not to exceed $14,400.00 as requested by the Director of Health and Human Services.**

9.    Approve and adopt the Regional Systemic Safety Analysis Report which compiles and analyzes fatal and severe injury crash data from 2013 to 2017 as requested by the Community Development Department Assistant Engineer.**

10. Approve an Amendment to the Del Norte County Administrative Policy and Procedures Manual, Article 5.10.707 reimbursement addressing per diem payments for meals during out of area travel as requested by the County Administrative Officer.**

11. Approve and appoint Linda Crockett to the Del Norte County Fish and Game Advisory Commission to represent District 2 as requested by the Local Fish and Game Advisory Commission.**

12. Approve and authorize the Chair to sign the 2019/20 Megabyte Property Tax System Maintenance Agreement as requested by the Treasurer-Tax Collector.**

SCHEDULED ITEMS

14. 10:35 A.M. 1) Receive a Health Career Pathways Presentation; and 2) approve and adopt a Proclamation recognizing and supporting the Health Career Pathway Project (Barbara Browning, Chief Operations Officer).**

15. 10:45 A.M. 1) Adopt the findings listed in the Planning Commission staff report; and 2) adopt the attached Ordinances for text amendments to Titles 20 and 21 of the Del Norte County Code as requested by the Community Development Department Planner.**

16. 10:55 A.M. Presentation from County Counsel regarding implementation of California's legal industrial hemp program in Del Norte County (Joel Campbell-Blair)

 

REGULAR ITEMS

GENERAL GOVERNMENT:

17. Authorize and direct staff to process the Title III funding application submitted by the Community Development Department requesting $15,000.00 per year for five years ($75,000.00) to supplement the Planning Division budget for natural resource planning services provided by County Staff as requested by the Director of the Community Development Department.**

18. Consider and approve the 2019/2020 fiscal year Border Coast Regional Airport (BCRAA) budgets as adopted by the Border Coast Regional Airport Authority Board of Commissioners as requested by the Border Coast Regional Airport Authority Director.**

19. Approve and authorize the Chair to sign and send a letter of support for the Front Street Pedestrian Improvement and Roadway Revitalization Project as requested by Supervisor Gitlin.**

20. Approve and adopt the Memorandum of Understanding (MOU) between the County of Del Norte and the Del Norte County Mid-Management Group (MMG) effective September 01, 2018, to coincide with the expiration of the previous agreement as requested by the County Administrative Officer.**

21. 1.) Introduce in title only: an Ordinance Setting Compensation of Members of the Del Norte County Board of Supervisors; 2) waive further reading; 3) set a hearing to Adopt the Ordinance; and 4) designate County Counsel to prepare a summary of the ordinance for publication as requested by the County Administrative Officer and County Counsel.**

22. 1) Introduce by title only an Ordinance Repealing and Replacing the Del Norte County Public Nuisance Ordinance; 2) waive further reading; 3) set a hearing to adopt the Ordinance on July 09, 2019; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by the Community Development Department and County Counsel.**

23. 1) Introduce by title only an Ordinance Establishing Animal Control Regulations for Del Norte County; 2) waive further reading; 3) set a hearing on July 09, 2019 to adopt the Ordinance; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by Animal Control and County Counsel.**

24. 1) Introduce by title only an Ordinance Repealing and Replacing the Del Norte County Administrative Citation Ordinance; 2) waive further reading; 3) set a hearing on July 09, 2019 to adopt the Ordinance; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by Animal Control, Code Enforcement and County Counsel.**

25. 1) Introduce by title only an Ordinance of the Del Norte County Board of Supervisors Amending Ordinance #2019-055 and Establishing the 2019 Master Fee Ordinance for the County of Del Norte in Accordance with Government Code Section 54985, ET SEQ.; 2) waive further reading; 3) set a hearing to adopt the Ordinance on July 09, 2019; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by the County Administrative Officer.**

26. Approve and adopt the updated Resolution Establishing Benefits for Appointed Department Heads as requested by the County Administrative Officer and County Counsel.**

27. Approve and adopt an updated Resolution Establishing Benefits for Unrepresented Confidential Classifications as requested by the County Administrative Officer and County Counsel.**

28. Approve and adopt the updated Resolution Establishing Benefits for Assistant Department Heads as requested by the County Administrative Officer and County Counsel.**

29. Approve and adopt the updated Resolution Establishing Benefits for Elected Department Heads as requested by the County Administrative Officer and County Counsel.**

 

BUDGET TRANSFERS:

30. Approve and adopt Budget Transfer #06-06 in the amount of $17,000.00 from the General Fund Contingency line to the Administration Professional Services Budget line to cover insufficiencies in the administration budget as requested by the Assistant County Administrative Officer.**

31. Approve and adopt Budget Transfer #06-10 in the amount of $1,950.00 within the Livestock Budget to cover costs associated with purchases for the rest of the 2018/19 Fiscal Year as requested by the Agricultural Commissioner.**

32. Approve and adopt Budget Transfer #06-13 in the amount of $5,000.00 from the General Fund Contingency Budget to the Board of Supervisors Travel Budget to cover the deficit for the remaining 18/19 FY as requested by the County Administrative Officer.**

33. Approve and adopt Budget Transfer #06-14 in the amount of $3,500.00 within the Environmental Health Division Budget  to cover the cost of Department of Toxic Substances Control staff time to review of test results from the Del Norte Pesticide Storage Area as requested by the Director of the Community Development Department.**

34. Approve and adopt Budget Transfer #06-16 in the amount of $55,024.00 within the Office of Emergency Services Budget for the Hazard Mitigation Grant for the completion of the update to the Multi-Jurisdictional Hazard Mitigation Plan as requested by the County Administrative Officer.**

35. Approve and adopt Budget Transfer #06-17 in the amount of $284,604.00 within the Mental Health Services Act Budget to decrease prudent reserves per Information Notice 19-017, 17-059 and 18-033 as requested by the Director of Health and Human Services.**

36. Approve and adopt Budget Transfer #06-18 in the amount of $25,000.00 within the Mental Health Budget due to the increased cost of Mental Health Client Transportation as requested by the Director of Health and Human Services.**

37. Approve and adopt Budget Transfer #06-20 in the amount of $9,500.00 within the Welfare Indigent Aid Budget due to the increase cost in General Relief (GR) payment for indigent aid and increase in GR caseloads as requested by the Director of Health and Human Services.**

38. Approve and adopt Budget Transfer #06-23 in the amount of $10,000.00 within the Recreation Budget for the purchase of a commercial lawn mower as requested by the Assistant County Administrative Officer.**

LEGISLATIVE AND BUDGET ISSUES:

Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

39. Direct staff to submit a letter to the National Fish and Wildlife Foundation requesting to have the Northern California Forest Watersheds Spring 2019 grant application filed by the Six Rivers National Forest transferred to Del Norte County as requested by the Director of the Community Development Department.**

40. Approve and accept the Independent Audit performed by Patel and Associates for the fiscal year ending in June 30, 2018 as requested by the Auditor-Controller.**

41. 1) Discuss and take action necessary to approve the 2019/2020 Fiscal Year Recommended Budgets as presented by departments; 2) approve the position list request for wireless device stipends as provided in the adopted Wireless Device Policy (Attachment B); 3) direct the Budget Team to continue to research and analyze all available cost saving options; 4) direct departments that no fixed asset purchases shall be allowed prior to the adoption of the Final Budget without Board of Supervisor approval; 5) direct departments that no budget transfers will be allowed that transfer funds from Salaries and Benefits to any other expense line unless determined to be an emergency by the County Administrative Officer and Auditor-Controller; and 6) accept the Recommended Children's Budget as presented, and direct staff as necessary (Attachment C) as requested by the County Administrative Officer.**
