REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Action: None.

·        Report of any actions from closed session by County Counsel.

Action: None.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time. In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports.

Action: Supervisor Gitlin: Dealt with constituent concerns on numerous different issues, participated in the freeway clean up meeting, attended the Special Board of Supervisors session and participated in the local beach clean-up. Supervisor Gitlin made a request to add to the October 08, 2019 Board of Supervisors Agenda and item to consider and suspend all future payments and enter into negotiations with the landlord of the vacated AOD property on 2nd street to settle the amount that’s due on the lease. 

Supervisor Cowan: Attended the DNSWMA meeting, attended the Last Chance Grade Stakeholders meeting, attended a meeting with constituents regarding homelessness, attended a TRUE North meeting regarding homelessness, attended a meeting with Jan Wortman regarding the upcoming Japanese Delegation visit, attended the Lincoln-Reagan Dinner, participated in Agenda review, attended the Special DNSWMA meeting, attended the Visitors Bureau meeting, attended the Board of Supervisors Special session, attended a meeting with Senator McGuire staff regarding homelessness, attended a meeting with County staff, City staff and constituents regarding homelessness and attended a meeting with the Airport Director regarding an upcoming meeting with ODOT in Washington DC.

Supervisor Howard: Attended the Natural Resource Goal Committee meeting, attended a meeting with Caltrans & LTCO regarding HWY 197/199 Litigation, attended a meeting with CDD and a Landowner regarding Saxton Boat Launch, attended the DNSWMA meeting, attended the Special DNSWMA meeting, participated in an interview with ABC Sports regarding the Sister City story airing during the 2020 Olympics, attended an update meeting with the local Food Council, attended the Board of Supervisors Special session, attended the North Coast Air Quality meeting and attended a meeting with Steve Perez regarding the possibility of a park in Hiouchi.

Supervisor Hemmingsen: Attended the Last Chance Grade Stakeholders meeting, attended a meeting with the NBC film crew regarding the Sister City story airing during the 2020 Olympics, dealt with constituent concerns regarding lower level crime burglaries, attended the Special Board of Supervisors meeting, participated in an interview with LA Times regarding the 1964 Tsunami, attended a Pacific Shores Stakeholder meeting regarding using the property for recreation,  participated in the Rockin’ at Rowdy fundraiser, attended the Future Facilities Goal committee meeting, participated in a conference call with Senator McGuire regarding updates in Del Norte County, attended the Green Diamond Celebration and took a look at the progress of the new Fort Dick Fire building.

Supervisor Berkowitz:  Attended the Board of Supervisors Special session, attended the Future Facilities meeting, attended the Lincoln-Reagan dinner, attended a meeting with the Director of DHHS and the Director of CDD regarding homelessness, attended the Chamber of Commerce meeting and attended a meeting with the Chamber of Commerce President.

5.    Approve and adopt a Resolution supporting the Dungeness Crab Fishery as requested by Supervisor Hemmingsen.**

6.    Approve and appoint Michael Tompkins as the Public Commissioner for the Del Norte Solid Waste Management Authority as requested by the Director of the Del Norte Solid Waste Management Authority.**

7.    Approve and authorize the Chair to sign a six-month Lease Agreement with Tab & Associates, Inc. for the Department of Child Support Services facility located at 983 3rd Street as requested by the Director of Child Support Services.**

8.    1) Approve and adopt a Resolution approving the proposed revisions to the Golden State Finance Authority Joint Powers Agreement; and 2) approve and authorize the Chair to sign the Amended and restated Joint Exercise of Powers Agreement with the Golden State Finance Authority as requested by the County Administrative Officer.**

9.    1) Approve and adopt the Memorandum of Understanding for the Dental Program between CSAC Excess Insurance Authority (EIA) and the County of Del Norte; and 2) authorize the County Administrative Officer to sign the MOU on behalf of the County of Del Norte as the Member Entity as requested by the County Administrative Officer.**

10. 1) Approve and adopt the Member Agreement for the CSAC Excess Insurance Authority (EIA) Drug and Alcohol Consortium between Plexus Global LLC and the County of Del Norte; and 2) authorize the County Administrative Officer to sign the Agreement on behalf of the County of Del Norte as the Member Entity as requested by the County Administrative Officer.**

11. Approve and authorize the Chair to sign the Memorandum of Agreement between the County of Del Norte and the Tolowa Dee-ni' Nation regarding Low Divide/Big Flat Fuels Reduction Project Funded by the National Fish and Wildlife Foundation as requested by the Director of the Community Development Department.**

12. Accept the Del Norte County CSA No. 1 and Crescent City Lift Station Rehabilitation Project as complete and authorize the Chair to sign the Notice of Completion as requested by the Community Development Department Assistant Engineer.**

13. Approve and authorize the Chair to sign the Agreement with the California Department of Public Health for the HIV Surveillance Program for the period of July 01, 2019 through June 30, 2024 as requested by the Director of Health and Human Services.**

14. Approve and authorize the Chair to sign the First Amendment to Agreement #2018-159 with Aurora Behavioral Healthcare - Santa Rosa, LLC to provide non-hospital psychiatric inpatient services from July 01, 2018 through June 30, 2019 as requested by the Director of Health and Human Services.**

15. Approve and authorize the Chair to sign the Agreement with the Del Norte Child Care Council for parent education services from July 01, 2019 to June 30, 2021 not to exceed $102,666.00 per Fiscal Year as requested by the Director of Health and Human Services.**

16. Approve and authorize the Chair to sign the renewal Agreement with Community Recovery Resources for residential treatment services for July 01, 2019 through June 30, 2020, not to exceed $30,000.00 as requested by the Director of Health and Human Services.**

17. Approve and authorize the Chair to sign the Memorandum of Understanding (MOU) between Del Norte County Department of Health and Human Services and Sutter Coast Hospital to participate in the drug discount program established under Section 340B of the Public Health Services Act ("the 340B Program") from September 24, 2019 until terminated by either party as requested by the Director of Health and Human Services.**

18. Re-appoint Elizabeth Cable as the position of County Counsel for a four year term as outlined in Government Code §27640 effective October 27, 2019.

LEGISLATIVE AND BUDGET ISSUES:

Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

24. 1) Conclude the public hearing and adopt the 2019/2020 Fiscal Year Recommended Budget as finally determined and all Special District Budgets by resolution as presented over the course of the budget hearing; 2) approve and adopt Resolution 2019-035, a Resolution Fixing Tax Rates for the Fiscal Year as required by Government Code; 3) approve and adopt Resolution 2019-036 setting appropriation limits for the Fiscal Year; 4) approve the annual Children's Budget as presented; 5) approve the use of the "Stimson" Fund for the internal leasing of one vehicle for the District Attorney, pending review and recommendation by the Proactive Financial Goal Committee; and 6) approve the position changes as outlined in Attachment 'A' as requested by the County Administrative Officer.**
