REGULAR MEETING                                                                    10:00 AM

 

The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

·        Nomination and election of Chair of the Board of Supervisors.

·        Nomination and election of the Vice-Chair of the Board of Supervisors.

·        Introduction of new employees to the Board of Supervisors

·        Report of any actions from closed session by County Counsel.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time. In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports.

Action: Supervisor Gitlin: Attended the PBSP Advisory Committee, attended the RCTA meeting, attended a meeting with the Agricultural Commissioner regarding issues at animal control, dealt with constituent concerns regarding overnight parking of RV’s and met with Commander Larry Depee regarding the issue. Supervisor Gitlin requested to place an item for discussion on the January 28, 2020 Agenda discussing California Vehicle Code 22651(k).

Supervisor Cowan:  Attended a meeting with Sutter Coast regarding homelessness, attended a meeting with Tamara Leighton and Daphne Cortes-Lambert regarding Del Norte Mission Possible, attended the Republican Women’s Luncheon, participated in Agenda review, attended a meeting with Caltrans regarding Last Chance Grade, attended the BCRAA meeting, attended a meeting with the Director of CDD, Roads Superintendent, the Assistant Engineer and CAO regarding the Pebble Beach Drive project and also participated in a conference call regarding the Pebble Beach Drive project, participated in a Focus Group with the City of Crescent City and participated in DNSWMA agenda review.

Supervisor Howard: Participated in the Japanese Delegation visit to Crescent City, attended the Public meeting regarding Wonderstump Road, attended the Special Tri-Agency meeting, attended the DNSWMA meeting, attended the RCD meeting, participated in the AB 1825 Sexual Harassment required training, attended a meeting with Kevin O’Donnell General Consultant of the Japanese Delegation, attended a meeting with the Chair of the CA Dept. of Fish and Wildlife regarding Elk Numbers in Humboldt and Del Norte County, participated in a Chamber of Commerce presentation, dealt with constituent concerns regarding Pebble Beach Drive, attended a meeting with Harbor Commissioner Wes White regarding the Klamath Dam and its effect on the Harbor and also attended a meeting with Caltrans regarding Hwy 199.

Supervisor Hemmingsen: Attended the RCRC meeting, participated in a conference call with Supervisor Howard and RCRC staff regarding the UC Cooperative Extension funding, attended the public meeting regarding Wonderstump Road, attended the Special Tri-Agency meeting, participated in the AB 1825 Sexual Harassment required training, attended the Redwood School holiday program, participated in a NCRP Conference call, attended a meeting with Kevin O’Donnell General Consultant of the Japanese Delegation, participated in a follow up conference call with RCRC staff regarding the UC Cooperative Extension funding and Jail improvements, participated in a Whale Entanglement conference call and also attended the BCRAA  meeting.

Supervisor Berkowitz:   Attended the RCTA meeting, participated in a NACo Conference call, attended the Republicans Forum meeting, attended a meeting with Caltrans regarding Last Chance Grade, attended the Chamber of Commerce retreat and participated in a meeting with Del Norte Ambulance and Metro West Ambulance and their Agreement.

 

CONSENT AGENDA

Comments from members of the public may be heard at this time regarding matters on the Consent Agenda only.

1.    Approve and adopt Minutes from the December 10, 2019 Board of Supervisors meeting.**

2.    Approve and adopt a Resolution recognizing The Del Norte High School 2019 Varsity Football Team as requested by the County Administrative Officer.**

3.    Approve and adopt a Resolution observing Soroptomist International of Crescent City Stop Trafficking Awareness Campaign as requested by Soroptomist International of Crescent City.**

4.    Approve and adopt a Resolution appointing members to the Del Norte County Law Library for the calendar year 2020 as requested by County Counsel.**

5.    Approve and authorize Jay Sarina, County Administrative Officer, to sign the grant deeds to divide APN 118-020-32, the parcel on which the Juvenile Hall is located, and to sign the certificate of acceptance on behalf of the County as requested by County Counsel**

6.    Approve and authorize the Amendment to Agreement #2017-113 with the Tolowa Dee-ni' Nation to reflect paving of a landscaping strip at the Mouth of Smith River Road and Indian Road in Smith River, CA. as requested by the Community Development Department Assistant Engineer.**

7.    Approve and authorize the Del Norte County Sheriff's office to fund award plaques, medals and ribbons to be presented to staff and volunteers of the Sheriff's Office in February for the 26th Annual LEADN Awards as requested by the Sheriff-Coroner.**

8.    Approve and adopt a Resolution approving grant of funds from the State Coastal Conservancy to the County of Del Norte for the Wavecrest and Pebble Beach Access Planning Project as requested by the Director of the Community Development Department.**

9.    Approve the Subrecipient Agreement with the Del Norte Senior Center for Senior Nutritional Meal Services for a portion of the County's 2018 Community Development Block Grant and authorize the County Administrative Officer to execute all necessary documents associated with the above listed agreements as requested by the County Administrative Officer.**

10. Approve a Subrecipient Agreement with Court Appointed Special Advocates (CASA) for advocacy services for children in the juvenile dependency court system for a portion of the County's 2018 Community Development Block Grant and authorize the County Administrative Officer to execute all necessary documents associated with the above listed agreements as requested by the County Administrative Officer.**

11. Approve and authorize the Chair to sign the Second Amendment to the Substance Use Disorder Agreement with the State of California, Department of Health Care Services (DHCS) for the period of July 01, 2017 through June 30, 2020 as requested by the Director of Health and Human Services.**

12. Approve the application for the Whole Person Care Pilot Program Grant from the California Department of Health Care Services (DHCS), not to exceed $426,206.02, and authorize the Director of Health and Human Services to continue the application as requested by the Director of Health and Human Services.**

13. Approve and authorize the Chair to sign the Amendment to the Agreement between Department of Health and Human Services, Public Health Branch, and the California Department of Public Health for the Immunization Assistance Program, not to exceed $174,725.00 for the period July 01, 2017 through June 30, 2022 as requested by the Director of Health and Human Services.**

14. Approve and authorize the Chair to sign the Second Amendment to the Agreement with Restpadd, Inc., Red Bluff, CA to provide non-hospital acute psychiatric health care services from July 01, 2017 through June 30, 2020 increasing the total budget from $300,000.00 to $420,000.00 as this facility has been utilized more than anticipated, and more than the previous year as requested by the Director of Health and Human Services.**

15. Approve and authorize to sell the attached list of properties at a public internet auction, which are tax defaulted and subject to the Power of Sell as requested by the Treasurer-Tax Collector.**

SCHEDULED ITEMS

16. 10:25 A.M. COMMENT PERIOD:  Members of the public may address the Board on matters which are within the jurisdiction of the Board.  If you are addressing the Board regarding a matter listed on the agenda, you may be asked to hold your comments until the Board takes up that matter.  Please limit your comments to three minutes or less.

17. 10:35 A.M. 1) Receive a Presentation on SB 1383 from the Del Norte Solid Waste Management Authority/Cal Recycle; and 2) discuss and direct staff to work with the Del Norte Solid Waste Management Authority and City staff as needed to develop and present recommendations at a future Board of Supervisors meeting regarding County-specific strategies to address short-lived climate pollutants and the associated regulatory requirements as requested by the Director of the Del Norte Solid Waste Management Authority.**

 

REGULAR ITEMS

GENERAL GOVERNMENT:

18. State of the County address by Chair Cowan.**

19. Approve a 30 year longevity step to a Range A-2 Step J for the County Administrative Officer.

20. 1) Introduce by title only "An Ordinance renumbering certain sections of the Del Norte County Code relating to Animal Control and Administrative Citations; 2) waive further reading; 3) set a hearing for January 28, 2020 to adopt the Ordinance; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by County Counsel.**

21. 1) Introduce by title only " An Ordinance repealing Chapter 60 of Title 7 of the Del Norte County Code relating to medical Marijuana; 2) waive further reading; 3) set a hearing to January 28, 2020 to adopt the Ordinance; and 4) designate County Counsel to prepare a summary of the Ordinance for publication as requested by County Counsel.**

22. Approve and adopt an Ordinance repealing certain chapters of the Del Norte County Code relating to Bar-O Boys, The Department of Central Services and General Penalties as requested by County Counsel.**

23. Approve and adopt a Resolution declaring the existence of an emergency and directing staff to take necessary action to alleviate the flooding caused by the unabated increases in the levels of Lakes Earl and Tolowa by breaching the intervening sandbar between the lakes and the Pacific Ocean as requested by the Director of the Community Development Department.

 

BUDGET TRANSFERS:

24. Approve and adopt Budget Transfer #12-02 in the amount of $5,000.00 within the Livestock Budget Unit to utilize donated funds for spay/neuter and animal care as requested by the Agricultural Commissioner.**

25. Approve and adopt Budget Transfer #01-01 in the amount of $103,600.00 within the CDD/Planning Budget Unit for the Wavecrest and Pebble Beach Access Planning Project as requested by the Director of the Community Development Department.**

LEGISLATIVE AND BUDGET ISSUES:

Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.

26. Approve and authorize the Chair to sign and send a letter of support for increased funding for the University of California to support research in agriculture and to improve productivity and competitiveness of California's agricultural endeavors as requested by Supervisor Hemmingsen.**
