The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Public Comment on Closed Session items only.

 

Hold a closed session to consider and discuss litigation and personnel matters: I) Existing litigation pursuant to Government code 54956.9; Steelhead Construction vs. County of Del Norte CVUJ 12-1275; Discuss and take possible action on a settlement proposal for 1 Workman’s Compensation Claim. II) Anticipated litigation 1) Initiation of litigation Conference with Legal Counsel pursuant to Govt’ Code 54956.9 – two cases (c); III) Personnel negotiations pursuant to Government Code 54957.6 between County Negotiator and the Del Norte County Employees’ Association, Sheriff’s Employees’ Association, and represented and unrepresented bargaining units.  Conduct annual evaluation of Director of Child Support Services; Conduct annual evaluation of Building Maintenance and Parks Superintendent.

 

 

 

 

REGULAR SESSION 10:00 A.M.

10:00 A.M. Call the  meeting to order and take roll.

·        The Pledge of Allegiance to be led by Chair Finigan.

·        Introduction of new employees to the Board of Supervisors

Action: No new employees to introduce.  A plaque was however presented to James Carnegie upon his retirement for 12+ years of service to Del Norte County Office of Administration.

·        Report of any actions from closed session by County Counsel.

Action: No reportable action as a result of Closed Session.

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

Action: No deletions.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports. The Board may ask questions for clarification; make a referral to staff to take action to have a matter or business placed on a future agenda pursuant to Government Code 54954.2(a).

Action: Supervisor Gitlin:  Chaired Solid Waste Management Authority meeting; attended the Chamber Advocacy Committee Meeting; attended the Emergency Meeting regarding breaching of Lake Earl; also attended the Harbor Commission meeting regarding March Events;  participated in the Del Norte Citizens Advisory Committee appearing before the Curry County Commissioners requesting a letter of support  for Last chance Grade; also attended the Republic Central Committee meeting; traveled to attend the North Coast Air Quality Management meeting; participated in the Child Care Council Chamber mixer; Participated in the clean-up of the Gravesites at the local Cemetery and cleaned up 2/3 of the overgrowth; attended the LAFCO meeting; visited a blight site on Del Norte Avenue.

 

Supervisor Hemmingsen:  Attended the Border Coast Airport Authority meeting regarding funding for RSA project; attended the Pelican Bay Safe Citizen Advisory Committee;  attended the Local Transportation Commission meeting; also attended the Emergency Board meeting for the breaching of  Lake; attended meeting with AG community regarding issues that they are working on regarding water run-off; also attended the Resource Conservation meeting;  covered Agenda Review for Supervisor Finigan; also met with Constituents regarding Forest Service Roads.

 

Supervisor McClure:   Attend the Coastal Commission meeting last week where the Governor completed last vacancy on Commission;  attended the Senior Center meeting where the Personal Policy is being discussed; attended the Redwood Coast Transit Authority;  also attended meeting with School District.

 

Supervisor Sullivan:  Meeting at Gasquet airport regarding removal of trees at airport to address questions from residents - suggests that at a future meeting a representative from Caltrans Aviation come before the Board and answer questions; attended the Local Transportation Commission meeting; also attended the Emergency board meeting regarding Lake Earl; received calls last week when he was out of the office and wants everyone to know that he is working on returning the calls.

 

Supervisor Finigan:   Also attendee the Airport JPA meeting; attended the First 5 Meeting; participated in the weekly CSAC Conference Call; attended the Tri-Agency Meeting; also attended the CSAC Board Meeting; also attended a legislative session with Martin Hoshino regarding Prison Overcrowding; also met with the Former CAO of CSAC about future of County and Economic Development; also had multiple meetings with staff.

·        Receive a brief report from the County Administrative Officer.

Action: Has been participating in Employee /Contract Negotiations; Had several meetings regarding CDBG; also the budget team is in the middle of Mid-Year budgets; dealt with multiple issues from the Public.

3.     Approve the Minutes from the February 11, 2014 Board of Supervisors Meeting.**

Action: Approved.

4.     Approve the nominations to the Healthcare District 2x2 - Supervisor Sullivan and Supervisor Hemmingsen, as requested by Chair Finigan.

Action: Approved.

5.     Approve the nomination to the City/County 2x2  - Supervisor McClure and Supervisor Sullivan, as requested by Chair Finigan.

Action: Approved.

6.     Approve and adopt Resolution 2014-008 entitled a Resolution of the Del Norte County Board of Supervisors Declaring the Blight of the Crescent City Harbor Inner Boat Basin eliminated, as requested by County Administrative Officer.**

Action: Approved. Del Norte County Resolution 2014-008.

7.     Approve and adopt proposed Resolution 2014-009 Certifying Mileage for submittal to Caltrans, as requested by Deputy Director Community Development Department.**

Action: Approved.  Del Norte County Resolution #2014-009.

8.     Approve and authorize the Chair to sign Agreement with Debra Foster, LCSW for clinical license supervision services from March 1, 2014 through June 30, 2015, not to exceed $8,400, as requested by Director of Health and Human Services.**

Action: Approved.  Del Norte County Agreement # 2014-025.

9.     Approve and authorize the Application from the County of Del Norte to acquire properties through the Chapter 8 agreement sale process of the defaulted tax property and subject to Power to Sell authority as prescribed by the State Revenue and Taxation Code, as requested by Treasurer-Tax Collector.**

Action: Approved.

10. Approve and authorize Agreement to Purchase Tax-Defaulted property and adopt Resolution for the purchase of tax defaulted property for future mitigation/conservation for the creation and enhancement of wetlands, as requested by County Administrative Officer.**

Action: Approved.  Del Norte County Agreement # 2014-026.

11. Approve and authorize the appointment of Amira Long as the Consumer member of the Local Planning Council for Child Care and Development, as requested by Coordinator for the Local Planning Council for Child Care and Development.**

Action: Approved.

12. Authorize and approve budget Transfer 02-05 in the amount of $10,000 within the 238 Inmate Welfare budget unit, as requested by Sheriff/Coroner.**

Action: Approved Budget Transfer 02-05.

REGULAR ITEMS

GENERAL GOVERNMENT:

3.     Discuss and take possible action regarding Pledge of Revenue for Financial Assurances for Postclosure Maintenance and Potential Corrective Action relating to the Crescent City Landfill, as requested by Acting Director-Program Manager of the Del Norte Solid Waste Management Authority.**

Action: Matter pulled as it was not review and approved by County Counsel prior to submittal to the Board.  Matter to be brought back to the Board after approval from County Counsel.

4.     Discuss and take possible action to approve a Resolution calling an advisory election to allow voters of Del Norte County to voice their opinion regarding separation from the State of California and formation of a new state, as requested by County Administrative Officer.**

Action: Change of Motion:

Motion to approve a Resolution calling for an advisory election to allow voters of Del Norte County to voice their opinion regarding separation from the State of California and formation of the State of Jefferson.

5.     Direct County Code Enforcement staff to coordinate and work with City Code Enforcement to review existing Solid Waste Ordinances and provide direction to Board of Supervisors on what Authority Ordinances will be brought forward for Adoption, as requested by Supervisor Sullivan.

Action: Staff directed to request that County Code Enforcement staff coordinate with City Code Enforcement to review existing Solid Waste Ordinance and provide direction to the Board of Supervisors and City Council for adoption.

LEGISLATIVE AND BUDGET ISSUES:

6.     Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.
