The Board of Supervisors of the County of Del Norte and the governing body of all other special assessment and taxing districts, for which said Board so acts, is now meeting in regular session.  Only those items that indicate a specific time will be heard at the assigned time.  All other items may be taken out of sequence to accommodate the public and staff availability.  Items followed with a ** indicate material attached in the agenda packet.

A closed session may be held at some time during the meeting to discuss litigation and/or personnel matters.  There is a 90-day statute of limitations relating to decisions rendered after a public hearing of the Board of Supervisors and a 60-day statute of limitations relating to ministerial actions of the Board of Supervisors.  NOTE:  If you challenge the decision of the Board of Supervisors in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.  (Govt. Code § 65009).  When providing written correspondence to the Board of Supervisors you must provide a copy to the Clerk of the Board for inclusion in the official record.

Hold a closed session to consider and discuss litigation and personnel matters: I) Existing litigation pursuant to Government code 54956.9; Steelhead Construction vs. County of Del Norte CVUJ 12-1275; Discuss and take possible action on a settlement proposal for 1 Workman’s Compensation Claim. II) Anticipated litigation 1) Initiation of litigation Conference with Legal Counsel pursuant to Govt’ Code 54956.9 – two cases (c); III) Personnel negotiations pursuant to Government Code 54957.6 between County Negotiator and the Del Norte County Employees’ Association, Sheriff’s Employees’ Association, and represented and unrepresented bargaining units.  Conduct annual evaluation of Director of Child Support Services; Conduct annual evaluation of Building Maintenance and Parks Superintendent.

·        The Pledge of Allegiance

Action: The Pledge of Allegiance was led by Supervisor Finigan.

·        Introduction of new employees to the Board of Supervisors

Action: None

·        Report of any actions from closed session by County Counsel.

Action: None

·        The Chair requests any deletions, corrections or additions from Board members to the agenda at this time.  In order to add an item to the agenda, the matter must have come to the attention of the County subsequent to the posting of the agenda and the matter requires action before the next regular meeting of the Board of Supervisors.

Action: One addition. Supervisor Hemmingsen directed staff to appoint an appropriate staff member to attend the June 4, 2014 Fish and Wilidlife meeting concerning listing the grey wolf as an endangered species.

·        Receive other brief reports or announcements relative to the County of Del Norte programs and projects, progress of the two by two committees, goal committees and/or Board and staff travel/training reports. The Board may ask questions for clarification; make a referral to staff to take action to have a matter or business placed on a future agenda pursuant to Government Code 54954.2(a).

Action: Supervisor Gitlin:      Attended CSAC Legislative conference; attended Jefferson State town hall meeting; attended the Concious Living expo; attended LAFCO meeting; attended Solid Waste Management meeting; met with Veterans and City officials regarding Point of Honor memorial; attended Chamber of Commerce meeting; and placed flags at the cemetery and attended memorial in observance of Memorial Day.

 

Supervisor Hemmingsen:     Met with Martha Rice and Fair Manager regarding special tax; LAFCO meeting; CEA meeting; participated in agenda review; participated in various conference calls; BCRAA meeting; attended LTCO meeting; attended Memorial Day services.

 

Supervisor McClure:   Attended Coastal Commission meeting; attended meeting with Linda Horn at Sutter Coast; and attended daughter's graduation.

 

Supervisor Sullivan:    Attended CSAC Legislative conference; attended Solid Waste Management meeting; attended LTCO meeting; attended Tri-Agency meeting; and attended All County Band concert.

 

Supervisor Finigan:     Attended CSAC Legislative conference and CSAC Officer's meeting and CSAC Board of Director's meeting;  attended meeting with National and State Association of Supervisors; attended Western Interstate Region meeting for the National and State Association of Supervisors, in Anchorage, Alaska.

·        Receive a brief report from the County Administrative Officer.

Action: CAO Sarina:   Conducting first round of budget meetings; ongoing miscellaneous contract negotiations; attended meeting with City Manager regarding projects; attended CEA meeting; attended Tri-Agency meeting; ongoing Yurok Tribe negotiations; various staff and departmental meetings.

1.     Approve the Minutes from the May 13, 2014 Board of Supervisors Meeting.**

2.     Authorize and approve Resolution authorizing Agricultural Commissioner to sign an Agreement with the California Department of Food and Agriculture for work related to inspection and compliance of petroleum and automotive products for labeling, and advertising, in the amount of $825, as requested by the Acting Agricultural Commissioner.**

3.     Authorize and approve Resolution authorizing the County Agricultural Commissioner to sign an Agreement with the California Department of Food and Agriculture for work related to Sudden oak Death monitoring and enforcement in the amount of $7,152.80, as requested by the Acting Agricultural Commissioner.**

4.     Authorize the Chair to sign the Third Amendment to Agreement 2010-095 between the County of Del Norte and Jim Phillips Nursing, Inc., as requested by the County Administrative Officer.**

5.     Authorize and approve the Chair to sign the First Modification to the Summer Park Apartments HOME Program Loan Agreement No. 2011-136, as requested by the County Administrative Officer.**

6.     Authorize and approve the Member Agency Contribution Pledge to the Border Coast Regional Airport Authority in Support of Runway Safety Area Improvements, as requested by the County Administrative Officer.**

7.     Approve grant from California Department of Fish and Wildlife in an effort to continue the counting of salmon and steelhead fish in the Smith River, as requested by the County Administrative Officer.**

8.     Authorize and approve the Fourth Amendment to Agreement No. 2010-094 between the County of Del Norte and Tim Nicely M.D., Howard Croy, PA-C, and Katie Evans, PA-C, and authorize the Chair to sign, as requested by the County Administrative Officer.**

9.     Adopt a Resolution to install signs on certain state highways saying "Del Norte County / Where We Honor Veterans" and direct the Community Development Department to make the signs and apply for an Encroachment Permit from Caltrans, as requested by the Director of Community Development.**

10. Authorize and adopt the Resolution appointing James Buckles as Del Norte County's Agricultural Commissioner/Sealer of Weights & Measures and Animal Control Officer, as requested by the County Administrative Officer.**

11. Authorize and approve the Chair to sign the Second Amendment to the Agreement #2013-134 with Remi Vista, Inc. for Medi-Cal eligible Children, Youth and their Families' Mental Health Services effective July 1, 2013 through June 30, 2014 not to exceed $1,789,000, as requested by the Director of Health and Human Services.**

12. Authorize and approve the Chair to sign the Agreement with Coast Auto Center, Inc. for the period July 1, 2014 through June 30, 2015, not to exceed $20,000, as requested by the Director of Health and Human Services.**

13. Authorize and approve the Director of the Department of Health and Human Services to sign the Agreement with the Trustees of the California State University, on behalf of Humboldt State University (University), for a Social Work Program utilizing the Department of Health and Human Services for Supervised community experience from July 1, 2014 through June 30, 2019, as requested by the Director of Health and Human Services.**

14. Authorize and approve the Chair to sign the Agreement with Richard Pearcey dba: Del Norte Taxi for transportation services for the period of July 1, 2014 through June 30, 2015, not to exceed $20,000, as requested by the Director of Health and Human Services.**

15. Authorize and approve the Chair to sign the Agreement with the National Council on Crime and Delinquency for Structured Decision Making (SDM) Services from July 1, 2014 to June 30, 2015, not to exceed $20,775, as requested by the Director of Health and Human Services.**

16. Approve and adopt the Side Letter Agreement between the Del Norte County Sheriff's Employee's Association (SEA) and the County of Del Norte amending the catastrophic leave benefit provisions of the current Memorandum of Understanding, as requested by the County Administrative Officer.**

17. Review and approve the security agreement between Border Coast Regional Airport Authority and Del Norte County for a loan in the amount of $1.8 million dollars; 2)  Approve the securitized promissory note, as requested by the County Administrative Officer.**

18. Approve budget transfer 05-04 in the amount of $230,791 increasing the inter-fund cost plan revenue for the 13/14 FY and increasing the transfer out line to the unemployment fund.**

19. Approve budget transfer 05-05 in the amount of $61,000 for the Equipment Grant #C8956107 with the Department of Parks and Recreation, Dvision of Boating and Waterways, (DBW), as requested by the Sheriff-Coroner.**

20. Authorize and approve budget transfer 05-06 in the amount of $2,000 with the Agriculture budget, as requested by the Acting Agricultural Commissioner.**

22. 10:30 A.M. Read and introduce an Ordinance for the County of Del Norte adding a chapter 3.07 to Title 3 of the Del Norte County Code imposing a transactions (sales) and use tax for the purpose of funding the Del Norte County Fairgrounds for a period of seven (7) years, as requested by the Del Norte County Fair Manager.**

23. Authorize and approve the acceptance of a $3,000 grant from Noah's Wish Community Animal Preparedness and Safety Program, as requested by the Emergency Services Manager.**

24. Authorize and approve the County to grant a Public Utilities Easement for the benefit of Assessor Parcel Numbers 118-470-02 , 118-470-03, 118-020-33 and 118-020-32, as requested by the County Engineer.**

Action: Item will be placed on the June 10, 2014 Board of Supervisor's meeting agenda to allow County Counsel time to research the matter.

25. Authorize and approve Exhibit A, Annual Financial Plan, of the Sheriff's Department 5 year Cooperative Law Enforcement Agreement with the U.S. Forest Service.  Agreement #2011-035, as requested by the Sheriff-Coroner.**

26. Direct staff of the Community Development Department to research unpaved county roads that may be designated as non-highway or combined use, as requested by Supervisor Hemmingsen.

Action: Community Development staff were directed to research this matter and report back to the Board of Supervisors.

27. Review and discuss the Bay Meadows offer as made by BCRAA, as requested by the Airport Director.**

Action: This matter will be placed on the agenda for the June 10, 2014.

 

LEGISLATIVE AND BUDGET ISSUES:

28. Consider miscellaneous legislative and budget matters pertinent to the County of Del Norte.  Authorize the Chair to sign and send appropriate letters with respect to matters pending before the state or federal governments.
